Dubai, Wednesday, January 7th, 2026: The inhabitants of UAE, more so the expatriates, are being vehemently encouraged to register a will in the UAE after vital revisions that have been made to the Civil Transactions Law in the country. According to legal experts, such a choice might lead to some devastating effects, such as the fact that financial assets may be donated to charity in case a person dies without a will and without heirs.

The intentions of these changes are to eliminate the uncertainty that has existed long in regard to inheritance and provide better and quicker results to the families.

Reasons Why You Need To Leave A Will In The UAE

The new legal system dictates that the financial assets of a foreign resident who dies without a registered will and has no legal heir claiming him/her will be considered a charitable endowment. The management of these assets will subsequently be done on an official basis.

In the past, these cases were not frequently brought to book for years and this left bank accounts in the sector and families in the court undergoing protracted legal battles. The new regulations do away with this grey area -and it is more important than ever to register a will in the UAE.

What Would Happen If One Fails To Register A Will In The UAE

In case with the death of a resident, the person did not have a registered will, a number of problems may appear:

  • Freezing of bank accounts may include joint accounts.
  • It may be an asset allocation based on the legal regulation of asset distribution, rather than individual desire.
  • There are legal expenses and court delays that may be encountered by the family members.
  • In case there are no heirs, property can pass to charity, whether or not intended.

This is in the case of financial assets, including bank balances, investments, and vehicles, among other movable assets.

New UAE Law Is Only Applicable In Particular Cases

It is necessary to mention that the rule of charitable endowment is applicable in the situation when:

  • No will is registered, and
  • No legal heir submits a claim

This law does not include the idea of overriding family inheritance but rather it helps to clear the lack of ownership. The law will be widely published within the UAE Official Gazette which will require more procedural details.

The Reduction Of Legal Age Is Associated With More Changes

The UAE has further implemented reforms associated with age and legal capacity in addition to inheritance reforms:

  • Maturing of laws reduced to 18 years (21)
  • The minors (those who are 15 years old and above) are allowed to handle assets under the supervision of the courts.

Each of the cases will be considered separately to determine capability.

All these reforms are aimed at empowering young residents and promoting early financial responsibility and entrepreneurship.

Expats Need To Register A Will In The UAE As Soon As Possible

Estate planning is no longer an option since there is a large number of expatriates, especially Indian nationals, who live and work in the UAE. In order to register a will in the UAE it is to guarantee:

  • Your wealth bequeaths to your beneficiaries.
  • Your family is not subject to legal uncertainties and delays.
  • The wishes of the guardianship of the minor children are honored.
  • It takes a shorter time to obtain probate and transfer of assets.
  • A registered will gives legal assurance and tranquility in the hard times.

The Registration Location And Place Of A Will In The UAE

Depending on the individual circumstances, the residents can make a will using the formally recognised methods. These involve systems found in courts and will-registration centres that specialise in the distribution of assets and guardianship preference in accordance with the UAE law.

Professional advice should be sought on the legality of will because legal counsel recommends that the will must be valid, enforceable, and registered.

The Bottom Line

What it is telling is that you should register a will in the UAE to guard your property and your family. New laws are in place now, and not planning ahead may lead to consequences that are not found to be desirable.

Regardless of whether you own a property, have savings or just want to leave your loved ones clear of all confusion, one of the most significant financial choices a UAE resident can make is to take a step and leave the will registered.
