November 29, 2025 | Dubai, UAE: The United Arab Emirates has taken a historic step by introducing a UAE new rule for fostering children to establish inclusivity and compassionate social care. Through landmark amendments to its child welfare laws the UAE new rule for fostering children now allows resident expats regardless of their nationality or religion to apply to become foster parents. 

This progressive move updating the existing framework for the care of children of unknown parentage marks a significant recognition of the UAE’s cosmopolitan society and places the welfare of children at the absolute heart of its legal system. Previously fostering was primarily restricted to Emirati Muslim couples and single women.

 Now thousands of resident families who long wished to offer a stable home and loving support have a clear path forward under the UAE new rule for fostering children.

This change is more than just a legal amendment, it is a profound social shift. It ensures that more children deprived of a natural family have the chance to grow up in a safe supported home environment within the country they know. It is a testament to the nation’s commitment to modernizing its legal framework to reflect its diverse population. 

The introduction of the UAE new rule for fostering children allows expat couples and eligible single women to integrate more deeply into the social fabric of the Emirates by participating in this life-affirming responsibility.

Who is Eligible Under the Expanded Framework?

The new decree significantly broadens the eligibility and criteria making fostering accessible to a much wider pool of potential caregivers.This revision ensures that the focus is on the capability and stability of the home offered rather than solely on nationality or religious background.

For married couples the UAE new rule for fostering children permits any couple to apply provided they meet several core conditions:

  •  Both spouses must be UAE residents and living together.
  • Both must be at least 25 year old.
  • They must demonstrate the financial capacity to support the child.
  • They must be free from infectious diseases or psychological conditions that could impact the child’s well-being.
  •  Crucially they must sign a commitment to uphold the child’s identity and beliefs and they do not acquire inheritance rights reflecting the distinction between fostering (Kafala) and adoption.

For single women the UAE new rule for fostering children also provides a dedicated pathway. Single women who are 30 year old or above are now eligible to apply.This represents a major progressive step recognizing that single individuals can provide a nurturing and stable environment. 

Applicants must still meet the financial and health requirements ensuring the child’s welfare remains the top priority throughout the process. This expansion highlights the inclusive nature of the UAE new rule for fostering children.

Prioritizing Safety and Oversight

While access has been broadened, standards have not been lowered. The Ministry of Community Development (MoCD) and local authorities oversee the entire process maintaining stringent safety and oversight measures to protect the child.

Prospective foster parents must undergo comprehensive screenings which include criminal record checks detailed medical clearances and home assessments. These steps are standard requirements globally and are in place to ensure a safe environment.

The updated law also introduces more compassionate oversight measures regarding issues that may arise post-placement. Under previous rules a child could be removed immediately if a fault was found. 

The UAE new rule for fostering children now favors remedial action establishing a committee that will recommend steps to fix non-serious issues providing a more stable and supportive framework for both the child and the foster family. The entire system is built on providing stability hence financial stability and a history of good conduct are essential prerequisites before a placement can occur.
